Terms of Service

Important: By creating an account, downloading our desktop application, or purchasing token packages, you agree to these Terms of Service and our Privacy Policy. Please read them carefully.

1. Definitions

In these Terms: "RaceTagger," "we," "our," or "us" refers to Federico Pasinetti, operating as RaceTagger, based in Italy. "Service" refers to the RaceTagger website at racetagger.cloud, the RaceTagger desktop application for Windows and macOS, and all related services. "User," "you," or "your" refers to any individual or entity that accesses or uses the Service. "Tokens" refers to the digital credits purchased to use the AI analysis features of the Service. "Content" refers to photographs, images, and any other files you upload to or process through the Service.

2. Service Description

RaceTagger is an AI-powered race photography analysis service. The Service detects race numbers in photographs, matches them to participant databases, classifies scenes, and writes IPTC/EXIF metadata to image files. The Service is delivered through a desktop application (Windows and macOS) and a web platform.

We operate as a technology platform. We provide AI-powered tools and infrastructure, but we do not control the content uploaded by users. Photographers and event organizers are solely responsible for ensuring they have appropriate rights and permissions for all uploaded content.

3. Account Registration and Security

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

You must be at least 16 years of age to create an account. By registering, you represent and warrant that you meet this age requirement.

4. Desktop Application License (EULA)

4.1 License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the RaceTagger desktop application on devices you own or control, solely for your personal or internal business purposes in connection with the Service.

4.2 License Restrictions

You may not:

  • Copy, modify, distribute, sell, or lease the desktop application or any part of it
  • Reverse engineer, decompile, or disassemble the application, except where permitted by applicable law
  • Remove, alter, or obscure any proprietary notices or labels
  • Use the application to develop a competing product or service
  • Share your account credentials or allow others to use your licensed installation
  • Circumvent or attempt to circumvent the token system, rate limits, or any access controls

4.3 Updates

We may release updates, patches, or new versions of the desktop application from time to time. Some updates may be required for continued use of the Service. The application periodically checks for updates and will notify you when a new version is available.

5. Token Packages and Purchases

5.1 Token System

The Service operates on a token-based system. Each AI analysis of an image consumes one or more tokens depending on the model and features used. Tokens are purchased in packages and are non-expiring (they remain in your account until used). Token balances are non-transferable between accounts.

5.2 Pricing and Payment

Current token package prices are displayed on our pricing page at racetagger.cloud/pricing. All prices are in Euros (EUR) and include applicable taxes as calculated by our payment processor (Stripe Tax) based on your billing location. We reserve the right to change pricing at any time, but changes will not affect previously purchased tokens.

5.3 Nature of Purchase

Token packages constitute digital content within the meaning of EU Directive 2011/83/EU and the Italian Consumer Code (D.Lgs. 206/2005). Tokens are delivered immediately upon successful payment and begin being available for use right away.

6. Right of Withdrawal (EU Consumers)

Important notice for EU consumers: Under EU consumer protection law, you normally have a 14-day right of withdrawal from online purchases.

However, because token packages are digital content that is delivered immediately upon purchase and begins being supplied right away, you acknowledge and agree that:

  • The digital content is supplied immediately upon purchase;
  • You expressly consent to the immediate supply of the digital content;
  • You acknowledge that you lose your right of withdrawal once the digital content has been fully delivered.

This consent is obtained during the checkout process. By completing a purchase, you confirm that you understand and accept the waiver of the right of withdrawal for the digital content purchased.

If you believe you are entitled to a withdrawal or have not provided the above consent, please contact us at legal@racetagger.cloud within 14 days of your purchase.

7. Refund Policy

Given the digital nature of token packages and the immediate delivery described in Section 6, refunds are generally not available for purchased tokens. However, we will consider refund requests in the following circumstances:

  • Technical failure: If the Service was completely unavailable and you were unable to use purchased tokens due to a fault on our side, we may issue a full or partial refund or credit additional tokens to your account.
  • Duplicate purchase: If you were inadvertently charged twice for the same purchase, we will refund the duplicate charge in full.
  • Unused tokens: If you request a refund within 14 days of purchase and have not used any tokens from the purchased package, we may issue a refund at our discretion.

To request a refund, contact info@racetagger.cloud with your purchase details. We aim to respond to all refund requests within 5 business days. Approved refunds will be issued to the original payment method within 10 business days.

8. Content Policy and Upload Guidelines

8.1 Your Content

You retain full ownership of all photographs and images you upload to or process through the Service. By using the Service, you grant RaceTagger a limited, non-exclusive, worldwide license to process, analyze, store, and transmit your Content solely for the purpose of providing and improving the Service. This license terminates when you delete your Content or your account.

8.2 Prohibited Content

The following types of content are strictly prohibited:

  • Inappropriate or explicit content: No nudity, sexually explicit, or suggestive imagery
  • Minor protection: No photographs of minors (individuals under 18) without proper legal authorization and parental consent
  • Non-consensual imagery: No photographs taken or uploaded without appropriate permissions
  • Offensive content: No discriminatory, hateful, or harassing imagery
  • Illegal content: No content that violates any applicable laws
  • Misleading content: No manipulated or doctored images presented as authentic race photography

8.3 Authorization Requirements

Photographers and uploaders must ensure:

  • They have the legal right to photograph and process the images
  • Appropriate event permissions and accreditations are obtained
  • For events involving minors, proper parental/guardian authorization is secured
  • Compliance with applicable privacy and photography laws in their jurisdiction

8.4 Content Moderation

We reserve the right to review uploaded content, remove content that violates our policies, suspend or terminate accounts that repeatedly violate these Terms, and report illegal content to appropriate authorities.

9. Intellectual Property

9.1 Our Property

The RaceTagger name, logo, desktop application, website, AI models, algorithms, participant presets, sport category configurations, and all related technology are the intellectual property of Federico Pasinetti / RaceTagger and are protected by applicable copyright, trademark, and intellectual property laws.

9.2 Analysis Results

Race number identifications, participant matches, scene classifications, visual tags, and metadata generated by the Service from your photographs are your property. You may use these results freely in your professional workflow.

9.3 Participant Presets and Databases

Pre-built participant presets (driver names, team data, race numbers) provided by RaceTagger remain our intellectual property. Custom presets you create from your own data are your property.

10. AI Analysis Disclaimer

Our Service uses artificial intelligence and machine learning technology to detect race numbers and identify participants. While we continuously work to improve accuracy, AI analysis is inherently probabilistic and we cannot guarantee 100% accuracy.

Specifically, you acknowledge that:

  • Race numbers may be misread, especially in challenging conditions (motion blur, obstructed views, poor lighting, unusual angles)
  • Participant matching may produce incorrect associations
  • Scene classification and face recognition features are provided on a best-effort basis
  • IPTC/EXIF metadata written by the Service should be reviewed before final publication or delivery
  • Results may vary between different AI models and settings

You are solely responsible for verifying analysis results before using them in any professional, commercial, or editorial context. RaceTagger is not liable for any consequences arising from inaccurate AI analysis results.

11. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users in advance of planned downtime.

The Service depends on third-party infrastructure providers (including Supabase, Google Cloud, and Stripe). We are not responsible for outages or performance issues caused by these third-party services.

12. Limitation of Liability

To the maximum extent permitted by applicable law, RaceTagger and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the total amount you have paid to RaceTagger in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for fraud, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded or limited under applicable law, including mandatory consumer protection provisions under EU and Italian law.

13. Indemnification

You agree to indemnify, defend, and hold harmless RaceTagger, its operator, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to: your violation of these Terms, your Content, your use of the Service, your violation of any rights of a third party, or your violation of any applicable law or regulation.

14. Acceptable Use

In addition to the content restrictions in Section 8, you agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service or its systems
  • Resell, redistribute, or commercially exploit tokens or Service access
  • Use automated scripts, bots, or scraping tools to interact with the Service (except through our official API)
  • Interfere with or disrupt the integrity or performance of the Service
  • Submit false, misleading, or fraudulent information
  • Use the Service in a manner that violates the intellectual property or privacy rights of others

15. Account Suspension and Termination

15.1 By You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy. Unused tokens are forfeited upon account deletion and are not refundable.

15.2 By Us

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or abusive behavior, compromise platform security, fail to pay amounts due, or if we are required to do so by law. Where possible, we will provide notice before termination. In cases of suspension for investigation, unused tokens will be preserved and made available if the account is reinstated.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date, notify you via email, and display a notice on our website or desktop application. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree with the updated Terms, you should stop using the Service and contact us to close your account.

17. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. For EU consumers, this choice of law does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.

Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Milan, Italy. For EU consumers, you may also bring proceedings in the courts of your country of habitual residence.

You may also use the European Commission's Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr for alternative dispute resolution.

18. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and RaceTagger regarding your use of the Service.

Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time.

Language: These Terms are drafted in English. In the event of a conflict between this English version and any translated version, the English version shall prevail.
